What Makes Lyft Accidents Different from Others?

Although Lyft accidents are similar with other kinds of motor vehicle accidents, a new law has been made that applies where a vehicle accident involves a Lyft driver. Under this new law, the driver is subject to a certain set of insurance requirements that imposes various insurance rules depending on whether or not the driver carries a passenger when an accident occurs. Generally, below are the requirements of the rules:

  • The passenger should be present in the vehicle. Lyft drivers who are carrying a passenger should buy insurance that will cover up to $1.5 million in bodily injury, property damage, or death and $10, 000 worth of medical coverage.
  • The driver is searching for passengers. Even if the driver does not have a passenger inside the vehicle, but has their Lyft app operation to search for a passenger, the new law requires up to $50, 000 worth of bodily injury or death coverage per person, $25, 000 in property damage coverage, and $100, 000 worth of bodily injury or death coverage per accident.

The new Lyft insurance requirements don’t apply if the Lyft app of the driver is turned off. This means t hat the personal insurance policy of the driver should cover damages. Such rules exempt Lyft accidents from the no-fault insurance rule of the state that requires accident victims to use their own insurance coverage for compensation even if they did not contribute to the accident.

Retaining an Attorney After a Lyft Accident

Even if Lyft offers generous insurance coverage, it may not be able to offer full compensation in more serious accident cases. In other cases, the insurance companies may contest the claim to reduce their liability after the accident. An experienced Hudson County Lyft Accident Attorney works to help obtain fair compensation for medical expenses, psychological and emotional damage, pain and suffering, lost earnings, as well as lost consortium or support.
